Misdemeanors
Although there are many different reasons for being charged with a misdemeanor there are only two ways to be charged with a misdemeanor. The first is for misdemeanors where the penalty is 93 days or less in jail. For these, a police officer may issue a ticket and no warrant to arrest is necessary. The second is for misdemeanors with penalties greater than 93 days in jail. These require a prosecutor to issue a complaint and if you have not been arrested a warrant may be issued. The Police Officer is typically the Complainant. The Plaintiff is considered either the State of Michigan or the City, Village, Township etc that the misdemeanor occurred in. You are considered the Defendant.
The first step is for you to be arraigned. The main purpose of the arraignment is to advise you of the charges against you and to set bond, which can be of four distinct types, such as personal, cash, ten-percent or surety. Once this is done the case marches forward toward pre-trial and possibly trial.
As a Defendant charged with a misdemeanor you need an attorney with the experience, knowledge and fortitude to defend you. We will discuss your charges and develop a plan of action in light of the facts, your priorities and resources available.
